Terms of Service

Last updated: 2026-09-02

These Terms of Service ("Terms") govern your use of FoodTrack (the "Service"), operated by Simon Walker ("we", "us", "our"), a private individual based in Scotland, UK.

By creating an account or otherwise using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 18 years old, or the age of majority in your jurisdiction if higher, to create an account or use the Service. The Service is not directed at, and must not be used by, anyone under that age.

We enforce this requirement technically: registration requires you to provide your date of birth, and we reject registration outright if the date you provide implies you are under 18 at the time of signup. If we nonetheless discover that an account belongs to someone who does not meet this requirement — for example, because they provided a false date of birth — we will suspend or terminate the account and delete the associated data in accordance with our Privacy Policy.

Age-gating alone does not exempt the Service from statutory duties that apply where a service is realistically likely to be accessed by under-18s despite the gate, including risk-assessment duties under the Online Safety Act. We have assessed this risk and consider the combination of the age requirement above, the technical enforcement described above, and the absence of any under-18-oriented content or marketing, to be an appropriate and proportionate response. This assessment is reviewed periodically.

Beyond the legal basis for the age requirement, several of the Service's calculations (for example, energy and nutrient targets) factor in your age. A false date of birth doesn't just breach these Terms — it will also make those calculations inaccurate for you.

2. The Service

FoodTrack is a personal food, nutrition, and fitness tracking application. It allows you to log meals, weight and body measurements, hydration, workouts, and to upload photographs and files in support of that tracking (including nutrition-label photos, progress photos, and workout route files).

3. Your Content

"Your Content" means anything you upload, submit, or otherwise provide to the Service, including photographs, nutrition data, and workout files.

3.1 Prohibited content

You must not upload, submit, or otherwise provide any content that:

This is not merely a general "no illegal use" clause — it specifically and expressly covers the categories above, given the automated content-scanning described in section 3.2.

3.2 Automated scanning, moderation, and enforcement

All uploaded content is automatically scanned and moderated before it becomes visible within the Service (see our Privacy Policy for details of the specific services involved). We reserve the right, without prior notice to you, to:

We are not obliged to disclose the specific detection mechanisms, thresholds, or signals that led to content being flagged, removed, or an account being suspended. This applies uniformly to rejected uploads, suspended accounts, and reviewed reports.

Content that is flagged automatically or reported by another user may be removed or hidden pending review, and reinstated if the flag or report is found to be unfounded.

3.3 Misuse of the reporting feature

The Service provides a mechanism for users to report content. You must not misuse this feature — including mass reporting, or reporting content maliciously or in bad faith with no genuine belief that it breaches these Terms. We track report outcomes per reporting user and may take action, including suspending your ability to submit reports or suspending your account, if we identify a pattern of misuse.

4. Copyright and intellectual property

By uploading content (in particular, photographs of nutrition labels), you warrant that you own the content or have all necessary rights and permissions to upload it, and that doing so does not infringe any third party's copyright or other rights.

If you believe content on the Service infringes your copyright, contact us at foodtrack-support -AT- stwalkerster.co.uk and we will act on valid notices in accordance with our notice-and-takedown process.

Uploading content to the Service does not grant us, or any other user, any right to reproduce, redistribute, or resell that content beyond what is necessary to operate the Service (e.g. displaying a nutrition-label photo you've linked to a food item to other users who log the same product).

5. Data retention

How long we keep uploaded files and related records is set out in our Privacy Policy and, in more technical detail, our Retention Policy.

6. Disclaimer and liability

The Service hosts user-generated content and acts as a host for the purposes of applicable intermediary liability protections. We do not proactively review all content before it is visible, though it is subject to the automated scanning described above. On receiving a valid notice of unlawful or infringing content, we will act expeditiously to remove or disable access to it.

The Service and its nutrition/fitness tracking features are provided for personal, informational purposes only and are not medical advice. Use them at your own discretion.

To the maximum extent permitted by law, the Service is provided "as is" without warranties of any kind, and we are not liable for indirect or consequential losses arising from your use of it.

7. Suspension and termination

We may suspend or terminate your account for breach of these Terms, including as described in section 3.2. You may close your account at any time in accordance with the account deletion process described in our Privacy Policy.

8. Changes to these Terms

We may update these Terms from time to time. A change takes effect from the date shown at the top of this page. Where a change meaningfully affects you — for example, a change to what you're permitted to upload, how your account can be suspended or terminated, or how your data is handled — we will also email the address on your account before, or as soon as reasonably possible after, it takes effect. Continuing to use the Service after a change takes effect means you accept the updated Terms; if you don't agree with a change, you should stop using the Service and may close your account as described in our Privacy Policy.

9. Governing law

These Terms are governed by the laws of Scotland, and any dispute arising from them is subject to the exclusive jurisdiction of the Scottish courts.
